  • SDPI hails Supreme Court’s ruling on narco analysis The Social Democratic Party of India, (SDPI), has hailed the Supreme Court of India for ruling narco analysis, brain-mapping and polygraph tests without the consent of accused as illegal.

       A. Sayeed, SDPI's general secretary, in a statement said: "Hats off to Supreme Court for realizing that these tests violated the constitutional provisions and amounted to cruel and degrading treatment and unwarranted intrusion into personal liberty”.

        Sayeed said such tests invade into the privacy of an individual considered sacrosanct under the Right to Life and Liberty provided in the Constitution of India. The Supreme Court has rightly said: “We have elaborated how the compulsory administration of any of these techniques is an unjustified intrusion into the mental privacy of an individual. It would also amount to ‘cruel, inhuman or degrading treatment’ with regard to the language of evolving international human rights norms. Furthermore, placing reliance on the results gathered from these techniques comes into conflict with the ‘right to fair trial’.”, he stated.

        The SDPI general secretary expressed satisfaction that Supreme Court has trashed the argument of the Central Government that overriding public interest to investigate terrorist offences would require administration of such tests to procure evidence. The Bench rightly noted: “Invocations of a compelling public interest cannot justify the dilution of constitutional rights such as the ‘right against self-incrimination’,” Sayeed said.

        Sayeed pointed out that the Supreme Court has also said the Central Government’s contention that the use of these techniques will only be sought in cases involving heinous offences only rings hollow since there will no principled basis for restricting their use once the investigators are given the discretion to do so.

       He hoped that the investigating agencies would adhere to the directives of the Supreme Court and follow the guidelines of the National Human Rights Commission which had published it for the Administration of Polygraph Test (Lie Detector Test) on an Accused in 2000. The Court has observed that these guidelines should be strictly adhered to and similar safeguards should be adopted for conducting the `narco analysis technique’ and the `brain electrical activation profile’ test.

  • Police Atrocity Towards Agitators who Opposed Land Survey
    A proposed move by the Kerala govrenment to construct a four-lane road for an upcoming industrial project at Kinaloor in Kozhikode met with violent opposition from local people.
    The incident happened on Thursday morning, when the people blocked a team of government officials arrived at Kinaloor to undertake a survey for the proposed road. About 100 people, including women and old, were injured in a pitched battle followed.
    The protestors had blocked the road leading to the estate with large boulders and timber logs in the morning when the officials, led by Revenue Divisional Officer K.P. Remadevi, arrived for the survey. Soon a pitched battle broke out between the protestors and the police and women constables were seen, beating, dragging women and children from the frontline of the blockade.

    Soon after Chief Minister V.S. Achuthanandan who is away in Delhi saw the images of the clashes that were aired by local television channels, he asked the district officials to stop the survey and to police to withdraw from the scene.
    Following the chief minister's directives to the director-general of police to withdraw the police force from the area and to the collector to submit a report on the incidents, there was some easing of tension in the area. However, opposition to the road project is unlikely to ebb.

    Many villagers who were hurt in the clashes have vowed they will fight to the end to stop the move to construct the road through their village.

    The police resorted to a lathicharge to cow down the protestors and they responded by hurling stones. Several protestors, including women and children, were injured in the lathicharge. Some policemen also sustained injuries in stone-throwing. The police used a grenade and teargas to disperse the crowd. They chased the protestors into nearby houses and damaged vehicles parked outside.

    All the political organizations barring left front protested against the police brutality towards agitating people.

    A hartal was observed today in the Balussery and the Elathur Assembly constituencies in protest against police violence. The hartal, which was backed by UDF constituents, Social Democratic Party of India and BJP, was total in the whole area.

    Jokatte (Mangalore) : Social Democratic Party of India backed 15 candidates filed nomination for 62nd Thokoor Jokatte Gram Panchayat Election. A rally was conducted from KBS railway gate Junction to Panchayat office before candidates filing nomination. Muhammad Guttu, Athaullah A.M., Haji.T.A.Aliyabba, Husain Masitha, B.M.Rafiq, Muhammad Jamal and others were present at the time.

  • Gram Panchayath Election in Karnataka: 474 SDPI Candidates in Fray Manglore: Social Democratic Party of India Karnataka State Committee announces , 474 of it's candidates  are in fray to contest Gram Panchayath election in 244 wards of 118 Gram panchayaths in Karnataka.

    Election would be held in this month. Several political parties had been confounded with SDPI contesting in election and were threatening and pressuring on SDPI candidates to withdraw from the fray, he added.

    The party, which was formed to preserve the values of Indian constitution and democracy, says that it will protect the interest of Muslims, Daliths and other deprived communities of the society.

    The SDPI was established in New Delhi last year and opened its account in a Gram Panchayath election in Rajasthan. The SDPI candidate Mohammad Haneef had been elected as the Sarpanch of the Chann Panchayat in Sawai Madhopur district.

    Recently in sulya of Karnataka, Congress party had aligned with Bharathiya Janatha Party to defeat SDPI in APMC election. SDPI had lost this contest for one vote.

    Later in Bruhat Bengaluru Maha Nagara Palike (BBMP) election, held on March 2010, SDPI candidate Naznin Begum, who contested from Padarayanpuram ward, bagged 6032 votes and won by 2030 votes. Other SDPI candidates also performed well in this election.

    SDPI is away from both the BJP and Congress. However BJP does not desire the progress of Muslims. The party argues that after Independence, from past 60 years Congress has done nothing for Muslims, unless using them as vote banks.

    The party said that it would give chances for all deprived categories of society to contest election including Muslims and Daliths.

    According to a special report of the Kannada Prabha, leading daily of the state, BJP and Congress party might align in some places in this election, to defeat SDPI.

  • SDPI demands CBI probe in to rape charges against Halappa Banglore: Social Democratic Party of India has demanded CBI inquiry in to alleged rape charges against Food, Civil Supplies and Consumer Support Minister H.Halappa and said that incident was a big damage for the image of Karnataka Politics.

    Majid Kodlipete, Karnataka State President of SDPI, said, in press release that a woman has been raped by the Minister. Then how other women could seek protection from this Government?

    Social Democratic Party of India strongly condemns this incident, he added.
    He urged that police should arrest Halappa and should file case against him.

    He also said that the case should be handed over to the CBI as there are chances of twist in the case, since accused is in high occupation of the Government, he added.

    He said that SDPI demands resignation of Chief Minister B.S.Yaddiyurappa on moral ground as his council minister involved in the rape case.

    Protestors slammed the Government for its negligence, inaction and lack policy in power distribution raised slogans against govt plan to increase the tariff and urged the Government to take necessary steps to ensure power supply without hindrance.
